2 LAWSUITS CHALLENGE WEST LAFAYETTE REZONING FOR $3.87B SK HYNIX SITE

Three West Lafayette residents, in a pair of lawsuits filed this month, are challenging West Lafayette City Council’s decision in May to rezone 121 acres north of Kalberer Road for industrial use to clear the way for a $3.87 billion SK hynix facility that will assemble high-bandwidth memory chips.

The complaints, filed June 4 in two Tippecanoe County courts, make similar accusations that the city improperly ignored recommendations from experts in the community and from the Area Plan Commission to reject the site as home to the South Korean semiconductor company’s facility, saying it was too close to residential neighborhoods, schools and parks.

They also raise questions about improper notice about the rezoning process, a general lack of study or evidence about the potential impacts on the environment and the neighborhoods, and allegations of backroom negotiations between the city and SK hynix that influenced what was a controversial decision.

“The goal is to get that action set aside,” Arie Lipinski, an Indianapolis-based attorney representing two residents who filed one of the lawsuits, said this week. “They’re looking for a new location. They don’t want the project to be at the proposed site.”
