ALLEN’S ATTORNEY CALLS FOR HEARING ON ‘PATTERN’ BY PROSECUTOR IN DELPHI CASE
An attorney for Richard Allen this week renewed a call for a new hearing and a new trial, accusing the Carroll County prosecutor of admitting to not sharing with the defense team a prison inmate’s letters that pointed a finger at others in the 2017 murders of Delphi eighth-graders Abby Williams and Libby German.
In the latest in a series of post-trial filings, Andrew Baldwin, one of three attorneys who defended Allen, asked Judge Fran Gull to hold a hearing to force Prosecutor Nick McLeland to preserve and produce potentially exculpatory letters received before and during a trial that started in October 2024.
Baldwin also called on Gull to sanction McLeland, arguing that the prosecutor’s slow roll in releasing the letters – acknowledging that he’d received them only after being challenged to do so through a court filing – continued “a history of not turning over exculpatory evidence.”
