JUDGE ISSUES PROTECTIVE ORDER, AS SK HYNIX, PRF REFUTE ‘SECRECY REGIME’ CLAIMS IN REZONING LAWSUIT
Amid accusations lobbed by attorneys in both directions about just how much proprietary information should be out there for the public to see in a lawsuit over the rezoning for a $3.87 billion SK hynix semiconductor project in West Lafayette, a judge this week granted a protective order covering trade secrets and other financial information and real estate dealings tied to the case.
The order, issued Monday by Tippecanoe Circuit Judge Sean Persin, laid out a template for documents designated as “confidential” or “attorney’s eyes only,” along with a way to challenge those designations, as requested earlier in the month by the South Korean company, Purdue Research Foundation and the city of West Lafayette.
At odds are accusations by SK hynix, PRF and the city that the attorney for Lora Williams – a West Lafayette resident who initiated one of two lawsuits attempting to overturn a May 2025 rezoning decision and to stop construction – has been sharing confidential information released during the evidence-sharing phase leading up to trial.
In competing and contentious filings in the past week, both sides jabbed at the other.
