JUDGE: WL RESIDENTS SUING OVER SK HYNIX LOCATION HAVE ‘STANDING,’ DENIES ATTEMPT TO STOP LAWSUITS

A judge ruled Tuesday that three West Lafayette residents suing over a 2025 rezoning decision that cleared the way for SK hynix’s $3.87 billion semiconductor facility have legal standing to move forward to trial.

Tippecanoe Circuit Court Judge Sean Persin’s order denied an attempt by SK hynix, land owner Purdue Research Foundation and the city of West Lafayette to shut down complaints in a pair of lawsuits looking to overturn a city council rezoning vote and ultimately stop construction of the 400,000-plus-square-foot facility on 121 acres north of Kalberer Road.

Persin’s five-page order said the petitioners behind the lawsuits – one filed by Lora Williams, another by Sean Sasser and Karl Janich, all of whom live about a mile from the SK hynix site – had shown sufficient evidence of financial stakes and potential harm to their health, safety and welfare to carry on.

The judge wrote that questions about the trio’s standing could still be raised in a trial, which has yet to be set.

The ruling followed a May 14 hearing, where the city, SK hynix and PRF argued that the three residents live too far from the site and had no evidence, beyond speculation, that they’ve been harmed by the city council’s vote.
